TERMS AND CONDITIONS OF USE FOR REZO2U APP SERVICES (“REZO2u T&CS”)
About These Terms
1. These REZO2U User Profiles Terms and Conditions (Terms) apply to all Individuals that subscribe with a Registered Account on our REZO2U apps. The effective date of these REZO T&Cs shall be when the user profile successfully registers the user account with proof of purchase of a REZO product. By assessing an/or using the app REZO2U, you accept and agree to abide by the following Terms and Conditions of Use, which together with any other terms or notices posted on our App such as Privacy Notice, govern the relationship between you as user and REZO Group Sdn Bhd. Your access and use of the App services shall be governed by and construed in accordance with the laws of Malaysia. The trademarks, logos and service marks as well as content (including but not limited to information, communications, software, images, videos and sounds) (collectively, “Contents”) contained on the App belong to REZO, its content providers and third party licensors. You should assume that all Marks and Contents on the App are protected by copyright and applicable to intellectual property rights unless otherwise noted. You must not download, copy, republish, post or transmit the Marks and Contents in any form or by any means including but not limited to electronic, mechanical copying or recording without our prior written permission. Any unauthorized use of the Marks or Contents may violate copyright laws, trademark laws, the laws of privacy and publicity, and civil and criminal statutes. All our rights are expressly reserved.
2. User Profile refers to digital app product that allows individuals to share information such as purchased products, an overview, contact number, correspondence address. Service Requests (as defined in clause 14) and Reviews (as defined in clause 15) to user and the broader public.
3. Organisation refers to the REZO business represented on our Company Profile Web Page. References to “you” and “your” (and related terms) means the Organisation and its personnel, as applicable.
4. REZO Group Sdn Bhd refers to REZO (Registered Number 201901023127 (1332456-K). References to “we” and “us” (and related terms) mean the REZO Group unless otherwise stated.
5. With your consent, you authorise us to collect your personal data for after sales and service purposes. REZO agrees to provide the User Profile a list of product services (SKU), including extended warranty product prices (Extended Warranty Purchase).
6. REZO reserves the rights and may modify these Terms at any time, including changes to or discontinuation of the Company product (including features or functionality). Notice of changes will be provided by publishing the updated Terms on our website. You will be notified of any product changes 14 days before they take effect. The variation of terms provisions in the Advertising Terms of Use do not apply to these Terms.
7. It is your responsibility to ensure that the data on your Registered Account is current and accurate. We will not monitor changes or updates to your Registered Profile with us. You are solely responsible for any information you submit to us and any data that we source from you. You must check your information for errors or inaccuracy as soon as they are placed on your User Profile Page.
8. You may amend your User Profile Page (including Reviews) at any time by contacting our dedicated System Administrator or our Customer Service team. We will make amendments on your behalf as soon as reasonably practicable. If applicable, you may also could add information to and/or make amend to some sections of your User Profile Page.
9. We will only publish Content that meets our standards for publication. These standards exclude content that is factually incorrect, unlawful, harassing, threatening, harmful, tortious, defamatory, libellous, abusive, violent, obscene, invasive of another’s privacy, racially or ethnically offensive or otherwise in our opinion objectionable or damaging to us, Content uses without consent, in breach of third party rights, incentivised by third parties, contain poor grammar, reference illegal activities, or deemed unhelpful or not in the spirit of helping others will not be published.
10. Any Content submitted by you (including Reviews and Content published directly by you onto your User Profiles Page) may be moderated in accordance with our standards. We do not fact check Content to verify its accuracy and we do not endorse any Content submitted.
11. You acknowledge and agree that:
a. we may, at our absolute discretion, modify or suspend your User Profiles Page at any time and without notice if the Content does not meet our publication standards;
b. we reserve the right to remove User Profiles at any time and without notice, including all, or part of, the Content if it doesn’t meet our publication standards;
c. we have no obligation to provide you with any reporting data, insights or information regarding the performance of your User Profile Page;
d. we have no obligation to store, maintain or provide you with a copy of any content, except as required by applicable laws.
12. Subject to clause 17, you may request us to removal your User Profile Page by contacting our System Administrator or our Customer Service team. If your User Profile Page is removed, all your Listings (as defined in clause 18) will also be removed from our apps.
Your Obligations
13. You warrant and agree that:
a. you have the legal capacity and power to agree to be bound by these Terms and perform the obligations under them;
b. you will comply with the User & Content Guidelines stated herein;
c. all information, files and data submitted to us will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties;
d. you will not use your User Profile Page to upload, download, transact, store or make available data that is unlawful, harassing, threatening, harmful, tortious, defamatory, libellous, abusive, violent, obscene, invasive of another’s privacy, racially or ethnically offensive or otherwise in our opinion objectionable or damaging to us. You will not use your User Profile Page or the data contained within it for any illegal purpose.
Service Requests
14. Once you submit a service request, our system administrator will process it, our service technician team will respond within 48 hours for technical consultation.
Reviews
15. Users of our apps can post reviews providing feedback about their experiences at our Organisation (Reviews). If applicable, you may also be able to respond to Reviews. Any Reviews submitted by an individual User Profile Page and responses to such Reviews that are submitted by you must comply with our Community Guidelines. Each submitted Review will be moderated to ensure it meets our standards. We do not fact check each Review to verify its accuracy and we do not endorse any Review submitted. Permitted Reviews are published on an ‘as is’ basis without being edited by us.
16. Unless we are compelled by a relevant law or court order, the details of the reviewer will be kept anonymous and will not be released to any third party.
17. You will not be able to edit or delete any Reviews. If you a user of our apps considers that a Review on your User Profiles Page should not be displayed, you may flag the Review as inappropriate. Flagged Reviews will be re- reviewed by us. Reviews that do not meet the community guidelines will be removed at our absolute discretion. Our decision following such re-review is final.
18. The ‘flag as inappropriate’ function should only be used where you genuinely and reasonably believe a Review does not align with our Community Guidelines. Abuse of this function may result in us suspending or removing your User Profile Page.
Limitation Of Liability, Disclaimer, And Indemnity
19. The User Profile covenants and agrees that it shall indemnify and hold harmless to REZO (including its affiliates, employees, directors, third party service providers and agents) from any and all claims, liabilities, losses, expenses and damages (including all solicitor’s fee and legal cost) by reason of any claims, proceedings, actions, or liabilities arising from any breach of any provision of these REZO2U T&Cs by the Registered User, provided that the indemnity contained herein shall be without prejudice to any other rights or remedies of REZO and all such other rights or remedies are hereby expressly reverse to REZO. Such indemnity will survive the termination of these REZO2U T&Cs without limitation of time. We assume no responsibility, and disclaim all liability for the accuracy, completeness, legality, reliability, or availability of any Content on the User Profiles Page, including service request, wrong purchases, payments made in error, and reviews. Except where we are unable to exclude our liability under law, we, our officers, employees, agents and contractors will not be liable in any way to you or anyone else for any loss or damage arising out of or in connection with your User Profile Page, unless such loss or damage is caused by disputes, discrepancies, our fraud or wilful misconduct. You also agrees our limitation of liability includes, but not limited to, the transmission of any viruses which may infect your equipment, failure of mechanical or electronic equipment or communication lines or other internet connection problems such as inability to access your internet provider. While we have taken reasonable commercial endeavours to ensure security and maintenance of the App, we cannot and do not guarantee continuous, uninterrupted or secure access to the App. In general, if any of these Terms and Conditions of Use is determined to be legally invalid or unenforceable, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder Terms and Conditions of Use shall continue in effect.
